Hemp-Based vs THC-Based Products: What's the Difference?
Hemp-derived and THC-rich products come from the same plant — here's how they differ in THC content, legality, testing, and effects.

Walk into any wellness shop or scroll an online store and you'll see products labeled "hemp" sitting alongside classic THC products sold at licensed dispensaries. They can look similar — same plant family, same familiar cannabinoids — but there are real differences in how they're made, how they're regulated, and how they affect you. Here's a plain-language breakdown.
First, what is hemp?
Hemp and marijuana are both cannabis — botanically, they're the same species. The difference is legal, not biological. Under the 2018 Federal Farm Bill, cannabis is classified as hemp if it contains no more than 0.3% delta-9 THC by dry weight. Cannabis that exceeds that threshold is regulated as marijuana, which in California means it can only be sold through licensed dispensaries like Mission Cannabis Club.
Hemp-based products.
Most hemp products are built around CBD, which is non-intoxicating and legal in large quantities. That's why CBD oils, gummies, and topicals are widely available outside of dispensaries — in cafés, pharmacies, and pet stores.
You'll also find "hemp-derived THC" products, typically delta-8 or delta-9 THC gummies sold online and in convenience stores. These are usually made by chemically converting CBD extracted from hemp into THC. Because the starting material was legal hemp, producers argue the finished product is legal too — but the conversion process itself is largely unregulated at the federal level.
THC-based products at a licensed dispensary.
Products sold in a California licensed dispensary come from the regulated marijuana market. Every batch must be tested by a state-certified laboratory for cannabinoid content, pesticides, heavy metals, mold, and residual solvents before it can reach the shelf. Packages carry exact THC and CBD amounts, batch numbers, and a universal symbol, and purchases are tracked from seed to sale.
That testing requirement is the single biggest difference between the two markets. A dispensary product tells you precisely what's in the package; a hemp-derived product from an unregulated source may not have been tested by anyone.
Key differences at a glance:
- THC content — Hemp products must stay at or below 0.3% delta-9 THC by dry weight; dispensary products can contain any amount, clearly labeled.
- Where they're sold — Hemp products appear in general retail and online; THC products are sold only through licensed dispensaries to adults 21+ with a valid ID.
- Testing — Dispensary products are batch-tested by state-certified labs; hemp-derived products often have no independent testing requirement.
- How they're made — Hemp-derived THC is usually synthesized from CBD; dispensary THC comes directly from THC-rich cannabis flower.
- Price — Hemp products can be cheaper, but that often reflects the absence of testing, taxation, and regulatory oversight.
Do they feel different?
CBD-only hemp products won't get you high at any dose — they're valued for relaxation and wellness rather than intoxication. Hemp-derived THC gummies can be intoxicating, but because dosing and purity aren't verified, effects can be unpredictable; delta-8 in particular is reported as milder and sometimes muddier than delta-9. Dispensary THC products deliver the familiar, well-characterized cannabis experience with a known dose and onset time.
What to look for, whichever you choose.
- A certificate of analysis (COA) from an independent lab, matching the batch on your package.
- Clear labeling of total THC and CBD in milligrams per serving.
- For THC products: buy only from a licensed retailer — the license number should be displayed.
- Realistic expectations: start low (2.5–5mg THC) and wait at least two hours before taking more.
